Please read these terms carefully before using BeeVoice

Welcome to BeeVoice. BeeVoice is developed and created by Insta App SRL. By accessing or using our AI audio performance studio, you agree to be bound by these Terms & Conditions ("Terms"). If you do not agree to these Terms, please do not use our service.

1. Service Description

BeeVoice is an AI-powered platform that turns scripts into complete audio performances: directed AI voices, multi-character casts, sound effects and music, on demand. Our service includes:

• AI-generated voiceovers and character performances, directed with DirectorMode™
• AI-generated sound effects and original background music
• The AudioHive™ Performance Engine that assembles voices, effects and music into one production
• Commercial usage rights for generated content
• Various export formats and customization options

2. Account and License

2.1 Account Registration

To use BeeVoice, you must create an account with accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

2.2 License Grant

Upon purchase, BeeVoice grants you a personal, non-exclusive, non-transferable license to:

• Generate AI audio performances using our platform
• Download and use generated content for personal or commercial purposes
• Use content in client projects, advertisements, videos, podcasts, audiobooks, courses, social media, websites, and other media
• Modify, edit, and incorporate generated content into your own works

2.3 License Restrictions

You may NOT:

• Resell, redistribute, or sublicense the generated content as standalone stock audio, voice packs or sound libraries
• Share your account credentials with others
• Use the service to create illegal, defamatory, or harmful content
• Reverse engineer, decompile, or attempt to extract the source code or the underlying voice models
• Use automated systems to generate excessive content for resale purposes
• Claim the AI-generated content as exclusively your own copyrighted work

3. Commercial Usage Rights

All content generated through BeeVoice comes with full commercial usage rights, which means:

• Client Work: You can use generated audio in projects for paying clients
• Marketing: Use in advertisements, promotional materials, and social media campaigns
• Products: Incorporate into products you sell (courses, audiobooks, podcasts, videos, apps)
• Broadcasting: Use in TV, radio, film, streaming content, and online videos
• No Attribution Required: You don't need to credit BeeVoice (though we appreciate it!)

Important: The generated content may not be unique to you, as other users might generate similar content using similar scripts, voices and settings.

4. Payment and Refunds

BeeVoice offers a one-time payment for lifetime access, with no monthly fees. All payments are processed securely through our payment partners. For our refund policy, please see our Refund Policy.

4.1 Fair Use Policy: BeeVoice One-Time Access

Lifetime access, no subscriptions, no recurring fees. BeeVoice One-Time Access is a one-time-payment offering that gives you ongoing access to our AI audio generation engine for the lifetime of the service, with no monthly billing, no daily caps, and no per-generation charges under ordinary use. The overwhelming majority of our customers (more than 99%) will never encounter any practical ceiling.

To keep BeeVoice fast, stable, and economically sustainable for every user, any use of the words "unlimited", "no limits" or similar in our marketing and on our checkout pages refers to the absence of a metered, pre-paid balance under normal, individual, good-faith creator use. It does not refer to literally infinite, industrial-scale, automated, or commercially atypical consumption. All one-time-access plans are accordingly governed by this Fair Use Policy.

4.1.1 Good-Faith, Single-User Operation

"Good-faith use" means generations consistent with how a single human creator, marketer, small business owner, freelancer, or in-house content team would manually use the platform to produce voiceovers, character performances, sound effects and music for their own projects, clients, channels, or campaigns. Provided your usage stays within this pattern, you may continue to generate content for the lifetime of the service without any quota or surcharge.

4.1.2 Excessive or Abusive Use

Usage may be deemed excessive, abusive, or outside the spirit of the offering if, at BeeVoice's sole and reasonable discretion, it falls within approximately the top 0.5% of active users measured over any rolling twelve (12) month period, or if it materially exceeds the volume that a single human operator could reasonably produce through ordinary manual interaction with the platform. Indicators of excessive or abusive use include, without limitation:

• Generation volume, frequency, or pace inconsistent with single-user, human-driven workflows;
• Use of scripts, bots, headless browsers, queue stacking, multiple parallel sessions, or any other form of automation to multiply output;
• Account, credential, IP, or device sharing, including any pooled, team, or agency access not expressly authorized in writing by BeeVoice;
• Generating audio in bulk for the purpose of redistribution, resale, repackaging, stock-audio or voice libraries, or for training, fine-tuning, or evaluating competing AI models or datasets;
• Patterns of consumption that disproportionately use compute, storage, bandwidth, queue capacity, or model resources relative to the typical customer cohort.

4.1.3 Enforcement Actions

Where BeeVoice determines, in its sole and reasonable discretion, that an account is engaged in excessive or abusive use, BeeVoice may take any one or more of the following actions, without prior notice and without liability:

• Apply soft caps, rate limits, throttling, lower queue priority, daily or weekly generation ceilings, or temporary cooldowns to the account;
• Temporarily pause, restrict, or suspend specific features or the account as a whole;
• Require the user to upgrade to, or migrate onto, an enterprise, agency, or commercial plan more appropriate to their usage profile, at then-current pricing;
• Terminate the account and, at BeeVoice's sole option, refund a pro-rated portion of the original one-time payment in lieu of further service.

Wherever practical, we will reach out to the account holder before taking permanent action and offer the opportunity to bring usage back within ordinary limits. No refund is owed in any case where the account has already received generation value materially greater than the original purchase price.

4.1.4 Interpretation

Any ambiguity in the terms "unlimited," "lifetime," "no limits," "unrestricted," "fair use," or related expressions in our marketing, sales pages, checkout flow, dashboard, or these Terms shall be interpreted in light of this Fair Use Policy and BeeVoice's published descriptions of the service. Such terms shall not be read to require BeeVoice to deliver service in volumes that are commercially unreasonable, technically destabilizing, inconsistent with the typical pattern of individual creator use, or that would unfairly degrade the experience of other users on the platform. This Fair Use Policy forms a binding part of these Terms and controls in the event of any conflict with promotional language used elsewhere.

5. Content Generation and Quality

5.1 AI-Generated Content

BeeVoice uses advanced AI technology to generate content. While we strive for high quality:

• Results may vary based on script quality, direction and complexity
• Generated audio is created by AI and may occasionally have imperfections such as mispronunciations or unexpected pacing
• We do not guarantee specific results or outcomes
• Content quality depends on various factors including script clarity and system load

5.2 Content Ownership

You retain rights to the generated content for your use as outlined in these Terms. However, BeeVoice retains ownership of the underlying AI models, voices, technology, and platform.

6. Prohibited Uses

You agree not to use BeeVoice to generate content that:

• Violates any laws or regulations
• Infringes on intellectual property rights of others
• Contains hate speech, discrimination, or harassment
• Depicts or promotes illegal activities or violence
• Contains explicit adult content
• Attempts to impersonate real individuals, or imitate a real person's voice, without their permission
• Spreads misinformation, or is presented as a genuine recording of a real person in order to deceive
• Violates privacy rights of others

7. Service Availability

We strive to provide reliable service, but we do not guarantee:

• Uninterrupted or error-free service
• That the service will meet your specific requirements
• That all features, voices or models will be available at all times
• That generated content will be free from defects

We reserve the right to modify, suspend, or discontinue any aspect of the service at any time, with or without notice.

8. User Content and Data

8.1 Your Scripts and Prompts

When you input scripts and direction prompts to generate content, you grant BeeVoice the right to:

• Process your scripts and prompts to generate content
• Use anonymized script and prompt data to improve our AI models
• Store your generation history for your account access

8.2 Privacy

Your use of BeeVoice is subject to our Privacy Policy, which describes how we collect, use, and protect your personal information.

9. Intellectual Property

All rights, title, and interest in BeeVoice, including the platform, website, technology, AI models, voices, DirectorMode™, AudioHive™ and branding, are owned by BeeVoice and its licensors. These Terms do not grant you any rights to our trademarks or branding.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. BeeVoice disclaims all warranties, including but not limited to:

• Merchantability and fitness for a particular purpose
• That generated content will meet your expectations
• That the service will be uninterrupted or error-free
• That defects will be corrected

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BEEVOICE SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, or use
• Damages arising from your use or inability to use the service
• Any content generated through the platform

In no event shall BeeVoice's total liability exceed the amount you paid for the service.

12. Indemnification

You agree to indemnify and hold harmless BeeVoice and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use of the service
• Your violation of these Terms
• Your violation of any rights of others
• Content you generate or how you use it

13. Termination

We may terminate or suspend your access to BeeVoice immediately, without prior notice, if:

• You breach these Terms
• You engage in prohibited activities
• We are required to do so by law
• We decide to discontinue the service

Upon termination, your right to use BeeVoice will immediately cease. Sections of these Terms that by their nature should survive termination will survive.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of significant changes via email or through the platform. Your continued use of BeeVoice after changes are posted constitutes acceptance of the modified Terms.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction where Insta App SRL operates, without regard to its conflict of law provisions.

16. Dispute Resolution

Any disputes arising from these Terms or your use of BeeVoice shall first be attempted to be resolved through good faith negotiations. If unsuccessful, disputes may be resolved through binding arbitration in accordance with applicable arbitration rules.

17. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

18. Entire Agreement

These Terms, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and BeeVoice regarding the use of our service.
